Therefore, this construction lawyer Brian Keisacker has clearly and is willfully violating the law, ethics and whatever little credibility he ever had. He is a construction attorney and earns income from the construction industry, clearly a law violation and an ethics violation! In the world of construction there is a hardly known and rarely seen phalanx of regulators, inspectors, magistrates an array of construction boards one such board is the Sarasota County General Contractors Licensing and Examining Board made up from a ragtag bunch of untrained citizens who decide the fate of contractors with absolutely no oversight and little or no regard for the impact it's decisions have on the people it passes judgment on.
The board’s current chairman is Brian Keisacker an associate attorney with the law firm Ulrich, Scarlet, Wickman & Dean, P.A.,
Brian Keisacker leads the board in conducting public hearings where grants or denies local applicants licensure and even makes recommendations to the Board of County Commissioners concerning potential modifications to the building code. Most importantly, the Brian Keisacker headed board conducts disciplinary hearings of state licensed contractors and has the authority to destroy contractors businesses and strip their livelihood from them by revoking or suspending his or her privilege to obtain construction permits within Sarasota County.
Unbelievably Brian Keisacker orchestrates these meetings and hearings where he's not even qualified by law to sit on the Sarasota County General Contractors Licensing and Examining Board and Brian Keisacker does not care.
Brian Keisacker became an attorney in 2016 and soon there after applied for a position on the board. Brian Keisacker timing in applying for the board almost immediately after passing the Bar exam is not coincidental. Brian Keisacker sought membership on the board in a scheme to bolster his resume while gaining influence with the local legal community and construction industry as a marketing tool to obtain clients. Since his appointment to the board Brian Keisacker has asked exercised his clout on the board to further his private interest in representing individuals, contractors and companies in construction related litigation. This is illegal.
Brian Keisacker occupies a seat on the board reserve for a “citizen at large (consumer representative).” However the Sarasota County Ordinance is very strict with respect to who may hold the seat. Sarasota County Ordinance 22-127(3) specifically states:
"[t]he citizen at large member shall be selected for appointment from Sarasota County resident applicants deriving no income from any source connected with the construction industry." Sarasota County Code § 22-127(3) (emphasis added).

The ordinance is unambiguous as it was borne from Florida statute 489.131(10), and leaves no room for error No person earning any type of income from any source connected with the construction industry shall sit on the board as a citizen at large consumer representative. Yet Brian Keisacker is a construction attorney with the firm Ulrich, Scarlet, Wickman & Dean, P.A., and is the attorney of record in dozens of cases representing a variety of interests in the construction industry. This authors experience with Brian Keisacker in his capacity on the board has been an absolute displeasure to say the least. On several occasions Brian Keisacker has been confronted with the conflict his personal career creates with his chairmanship of the board, yet he is deliberately indifferent with his chairmanship on the board, yet Brian Keisacker proceeds with impunity. Brian Keisacker has been asked to resign his position on the board, but he defiantly refuses.
Brian Keisacker leads the board with a smug arrogance not often seen in public government proceedings. He dares those who challenge his qualifications to complain to the Florida Bar, of which he is a member.
Twice a Circuit Court judge has ruled that the Brian Keisacker chaired board violated this author’s Constitutional due process rights, reversing orders issued by the board. To view the Circuit Court rulings scroll down. 
Recently at an August 15, 2019, hearing when faced with a request to recuse himself, Brian Keisacker displayed an unreasonable indifference as shown below:

CONTRACTOR: “Brian Keisacker sits on the board as a consumer representative. Sarasota County ordinance states that consumer representatives must not derive any income from the construction industry. Mr. Keisacker is employed by a law firm and his main area of law he practices is construction law. He has several dozen active cases in the 12th Judicial Court where he represents a variety of parties in the construction industry dealing with a myriad of construction issues. Keisacker also represents parties in front of the Sarasota County Code Enforcement Special Magistrate. There is no question that Mr. Keisacker derives a significant income from the construction industry and is unqualified to serve on this board. I hereby request a vote on my motion to disqualify the board.
CHAIRMAN KEISACKER: This board being without jurisdiction there's no grounds for a vote so you're invited to carry on with your motion to stay. 
CONTRACTOR: Okay. Mr. -- Attorney Brian Keisacker, the rules -- the rules regulating the Florida Bar state that a lawyer shall not engage in conduct that is prejudicial to the administration of justice. That rule is under the ethics Chapter 4, which is 4-8.4(d) as in David. I hereby request that you recuse yourself from this hearing and this board.
CHAIRMAN KEISACKER: There's no basis with which this board has been presented –
CONTRACTOR: Yes, it has.
CHAIRMAN KEISACKER: -- that would require me to recuse myself at this time --
CONTRACTOR: It's been presented at the motion to disqualify.

CONTRACTOR: Okay. I believe that you're violating the rules regulating the Florida Bar and I believe that it's unethical and you should not be serving on this board. And you've known for a long time that you derive income from the construction industry and are unqualified to serve on this board.
CHAIRMAN KEISACKER: And if you feel that way, I invite you to inform the Florida Bar that you feel I'm in violation --

It is this author’s opinion that Brian Keisacker chairs the board with an obvious air of false civility. Brian Keisacker is unscrupulous in his leadership that often results in contractor’s complete loss of livelihood and business. Brian Keisacker is without a moral compass and has taken the unethical path as an attorney in pursuit of power, influence and greed. One cannot imagine a more glaring example of an attorney utilizing ill-gotten influence as chairman of a board for financial gain in his private employment. Such behavior is unacceptable, unprofessional and blatant violation of the law. 
Rule 4-8.4 Rules Regulating the Florida Bar best describes the type of prohibit misconduct exhibited by Brian Keisacker.
RULE 4-8.4 MISCONDUCT
(a) violate or attempt to violate the Rules of Professional Conduct, knowingly assist or:
A lawyer shall not:

(c) engage in conduct involving dishonesty, fraud, deceit, or misrepresentation, except that it shall not be professional misconduct for a lawyer for a criminal law enforcement agency or regulatory agency to advise others about or to supervise another in an undercover investigation, unless prohibited by law or rule, and it shall not be professional misconduct for a lawyer employed in a capacity other than as a lawyer by a criminal law enforcement agency or regulatory agency to participate in an undercover investigation, unless prohibited by law or rule;
(d) engage in conduct in connection with the practice of law that is prejudicial to the administration of justice, including to knowingly, or through callous indifference, disparage, humiliate, or discriminate against litigants, jurors, witnesses, court personnel, or other lawyers on any basis, including, but not limited to, on account of race, ethnicity, gender, religion, national origin, disability, marital status, sexual orientation, age, socioeconomic status, employment, or physical characteristic;
(e) state or imply an ability to influence improperly a government agency or official or to achieve results by means that violate the Rules of Professional Conduct or other law;
Brian Keisacker is aware of the conflict between his private and public interests, but he defiantly proceeds with his unethical and callous indifference. Brian Keisacker should not be allowed to serve on the Sarasota County General Contractors Licensing and Examining Board one minute longer, where he will continue to wreck the lives of those he judges in his own hypocrisy. Perhaps Brian Keisacker does not care, however we do and will do all can to ensure that the laws of this state and County are adhered to. 
The Circuit Court in case number 2018-CA-916 and 2018-CA-1530 determined as follows:
“The difficulty in the present case is that the record reflects that the Board denied the motion for stay without affording Petitioner a meaningful opportunity to present evidence and argument relative to the White Construction factors. The constitutional guarantee of due process requires that each litigant be given a full and fair opportunity to be heard. Vollmer v. Key Development Properties, Inc., 966 So. 2d 1022, 1027 (Fla. 2d DCA 2007). Allowing a movant five minutes to present his case during an "open to the public" portion of a board meeting does not comport with due process. See Julia v. Julia, 146 So. 3d 516, 520 (Fla. 4th DCA 2014). Under principles of due process, it is unacceptable for an administrative board to decline to hear and determine the merits of a movant's motion to stay. Because the Board in the present case did not conduct a meaningful hearing on the motion to stay, there is no record from which the Court may determine whether denial of the stay was within the Board's discretion. See Sunbeam Television Corp. v. Clear Channel Metroplex, Inc., 117 So.3d 772 (Fla. 3d DCA 2012). Therefore, it is appropriate to remand the motion for stay to the Board for consideration on the merits.”

The Sarasota County General Contractors Licensing and Examining Board is made up of a ragtag bunch of untrained citizens (as once said "it's like a bunch of people stumbled into a room and have no idea why they are there and what they are doing") that unfairly decide the fate of legitimate contractors. This ragtag bunch of wandering and untrained people have absolutely no oversight and no regard for the impact their decisions have on the people they pass judgment on, nor do they have any concept of what the law says. Brian Keisacker and the Sarasota County General Contractors Licensing and Examining Board, when you hang a man and destroy my life, you better remember what I look like, you will one day see me in court again to vindicate what you have done to me. You will have to face a judge and jury of my peers for judgement in the legal arena when you are called to answer for your malicious, illegal, selective enforcement and unjust behavior when you targeted me.
The Sarasota County General Contractors Licensing and Examining Board chairman is Brian Keisacker an associate attorney of the law firm Ulrich, Scarlet, Wickman & Dean, P.A., Sarasota, Florida.
Unbelievably, Brian Keisacker conducts these meetings and hearings where he is not even qualified by law to be on the Board and Brian D. Keisacker doesn't care. Since his appointment to the Sarasota County General Contractors Licensing and Examining Board, Brian Keisackers' position is un-ethical and illegal. He also refuses to resign, even though Brian Keisacker knows it's illegal. Sarasota County Ordinance 22-127(3) specifically states: "[t]he citizen at large member shall be selected for appointment from Sarasota County resident applicants deriving no income from any source connected with the construction industry." No person deriving any type of income from any source connected with the construction industry shall not be on the board as a citizen at large consumer representative. Yet Brian Keisacker is a construction attorney with the firm Ulrich, Scarlet, Wickman & Dean, P.A., and is the attorney of record in dozens of cases representing a variety of interests in the construction industry. A significant percentage of Brian Keisacker salary in fact is from construction litigation, a clear and undeniable conflict of interest with state of Florida and Sarasota municipal law. This authors experience with Brian Keisacker in his capacity on the board has been an absolute nightmare to say the least. On several occasions Brian Keisacker has been confronted with the conflict his law career creates with his chairmanship of the board, yet he is "deliberately indifferent" with his chairmanship on the board. Brian Keisacker proceeds with impunity. Brian Keisacker has been asked to resign from the Sarasota County General Contractors Licensing and Examining Board, Brian Keisacker defiantly refuses.
Brian Keisacker also leads the board with a smug and unjustifiable arrogance not often seen in public government proceedings, where fairness and the law is too be followed. Brian Keisacker dares and challenges those who confront his violation of the qualifications to complain to the Florida Bar, of which he is somehow a member.
Several times a Circuit Court Judge has ruled that the Brian Keisacker chaired board violated this author’s Constitutional and due process rights, reversing orders issued by the board. And Brian Keisacker is a lawyer? Yeah, absurd!
Rule 4-8.4 Rules Regulating the Florida Bar best describes the type of prohibit misconduct exhibited by Brian Keisacker. RULE 4-8.4 MISCONDUCT
(a) violate or attempt to violate the Rules of Professional Conduct, knowingly assist or... " lawyer shall not: induce another to do so, or do so through the acts of another;
(b) commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects;
(c) engage in conduct involving dishonesty, fraud, deceit, or misrepresentation, except that it shall not be professional misconduct for a lawyer for a criminal law enforcement agency or regulatory agency to advise others about or to supervise another in an undercover investigation, unless prohibited by law or rule, and it shall not be professional misconduct for a lawyer employed in a capacity other than as a lawyer by a criminal law enforcement agency or regulatory agency to participate in an undercover investigation, unless prohibited by law or rule;
(d) engage in conduct in connection with the practice of law that is prejudicial to the administration of justice, including to knowingly, or through callous indifference, disparage, humiliate, or discriminate against litigants, jurors, witnesses, court personnel, or other lawyers on any basis, including, but not limited to, on account of race, ethnicity, gender, religion, national origin, disability, marital status, sexual orientation, age, socioeconomic status, employment, or physical characteristic;
Brian Keisacker is fully aware of the conflict between his private and public interests, but he defiantly proceeds with his unethical, careless and callous indifference. Brian Keisacker should not be allowed to be on the Sarasota County General Contractors Licensing and Examining Board any longer, where he continues to wreck the lives of those he judges in his own hypocrisy. Brian Keisacker obviously does not care, we do and will do all can to ensure that the laws of this state and County are adhered to.

Absolute power corrupts absolutely. Without checks and balances, laws, and proper institutions in place, tyrants and dictators can quickly consolidate power and cause a tremendous amount of suffering. Sadly, every once in a while, politicians and leaders decide to do things their own way (much to the dismay of the masses). From communist leaders to tribal despots, these cold-blooded dictators do not care for the value of life as much as they do achieving their selfish motives of domination, power, and immortality. Now, this is what the Sarasota County Commissioners have allowed with members of the Sarasota County contractor boards who are unqualified, they have ignored the law. If they are corrupt with these things, what else are they doing?
